The new procedure requires Board panels to address all grounds raised in the petition in their final written decisions. This approach is designed to promote compact decision making. The memorandum applies to all proceedings where an oral hearing has not yet occurred. The new procedure does not impact institution decisions.
Here is the MEMORANDUM, which can be find here Learn more :
Effective immediately, absent extraordinary circumstances, all Board panels assigned to an inter partes review or a post-grant review proceeding where an oral hearing has not yet occurred will address all grounds raised in the petition in their final written decisions. Among other reasons, this approach will promote compact decision making and ensure that panels will not be required to address grounds for the first time in the event of a remand from a Director Review decision or Federal Circuit appeal.
